“Girl Falls Off Disney Cruise Ship: Incident Deemed Preventable”

A young girl, aged five, tumbled off a Disney Dream cruise ship in June while posing for a photo on a porthole railing as per Florida authorities’ reports obtained by CBC News. The Broward County Sheriff’s Office labeled the incident as “preventable” in a report filed on June 30, the day following the occurrence when the child went overboard and her father leaped in to rescue her as the ship was returning from the Bahamas en route to Port Everglades in Fort Lauderdale.

The state attorney, in their report, criticized the mother’s actions in arranging the photo as “potentially negligent and careless,” yet concluded that it did not warrant criminal charges. The incident gained global attention after both the child and father were saved by the cruise ship crew, with the dramatic rescue being documented in videos shared on TikTok by passengers.

Based on the police’s timeline established through security footage, the family was strolling on the port side of deck four around 11:29 a.m. when the mother directed the child to the porthole railing. Subsequently, the child sat on the railing, lost balance, and fell around 49 feet into the water below. The father followed suit and jumped to rescue her approximately 45 seconds later.

By 11:49, the ship’s rescue boat successfully retrieved both the child and father from the water. The child suffered from hypothermia, while her father sustained a spine fracture. In his statement to the police from his hospital room, the father, to protect the child’s privacy, recounted that the family was on deck four when his wife paused to photograph their daughter seated on the railing.

Although the police classified the fall as “preventable” in a supplementary report and intended to have the case reviewed by the Broward County State Attorney’s Office, no charges were pressed, and the case was eventually closed. A report from the assistant state attorney highlighted that while the mother’s behavior could be deemed negligent and irresponsible, it did not meet the level of criminal negligence.

It is uncommon for passengers to fall overboard, as indicated in a report by the Cruise Lines International Association, where only 212 individuals fell overboard between 2009 and 2019, representing a minute percentage of passengers and crew. Among those incidents, 48 individuals were rescued, with each case being attributed to an intentional or reckless act following investigations.
