“CMA Investigates 8 Companies, Warns 100 More”

Investigations are underway into eight companies due to concerns regarding their online pricing strategies, with an additional 100 businesses expected to receive warnings.

The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical. The Competition and Markets Authority (CMA) is focusing its investigations on the transparency of fees displayed online, potential misrepresentation of time-limited offers, and the automatic inclusion of optional charges without customer consent.

StubHub and Viagogo, secondary ticket selling platforms, are specifically being examined for additional charges imposed during ticket purchases. Meanwhile, AA Driving School and BSM Driving School are being probed for their fee presentation methods and whether these are clearly communicated at the start of the transaction process.

Gold’s Gym is being scrutinized for introducing a one-off joining fee for its yearly membership midway through the sign-up process. Wayfair is under investigation for its time-limited sales practices, while Marks Electrical and Appliances Direct are being looked into for default opt-ins and the use of time-limited sales and default opt-ins, respectively.

The CMA has initiated these investigations based on suspicions of consumer law violations, emphasizing that no final decisions have been reached yet. These cases mark the inaugural instances of the CMA exercising its new consumer protection powers. The authority has also announced plans to contact 100 other businesses regarding concerns about their fee structures and sales tactics.

CMA’s Chief Executive, Sarah Cardell, emphasized the importance of ensuring transparent pricing for consumers and safeguarding against misleading sales practices. Cardell reiterated the commitment to enforcing consumer protection laws and holding businesses accountable for fair dealings with customers.

Representatives from AA Driving School and Viagogo have expressed willingness to cooperate with the CMA’s investigations. The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for their comments. It is noted that BSM Driving School is a subsidiary of the AA, while Viagogo and StubHub share the same parent company.
