L, a 21-year-old law student at the University of Hong Kong, expressed her initial shock upon discovering that another student had produced non-consensual AI-generated pornographic images of her. Initially, she blamed herself, questioning if there had been a misunderstanding. Feeling shocked and fearful, she refrained from using social media for a period to avoid potential exposure of her photos to unauthorized individuals.
The male student’s former partner stumbled upon over 700 photos in February, including AI-generated explicit images, without the victims’ consent. These photos, sourced from social media screenshots, depicted the women in compromising positions. In response, L, B, and H, three law students at HKU, decided to publicly address the incident by sharing their story on an Instagram account.
Despite the male student’s admission of using their photos to create AI-generated pornographic content, the University of Hong Kong’s initial actions were deemed insufficient by the victims. Subsequently, further actions were promised by the university as the case remains under review. Notably, the lack of legal framework criminalizing AI-generated pornography creation in Hong Kong has hindered the victims from filing a police report.
This case sheds light on a global issue concerning the unregulated creation of non-consensual AI porn. Various countries, such as Canada and South Korea, have taken legislative steps to address this problem. In Hong Kong, concerns regarding the increasingly realistic nature of AI-generated content have raised challenges in identification and regulation. Additionally, the limitations of existing laws in safeguarding individuals above the age of 16 from such offenses have been highlighted.
As efforts are made to combat the proliferation of deepfake pornography, the victims continue to grapple with the psychological impact and uncertainties surrounding the enforcement of laws in the digital realm. The pervasive nature of AI technology presents a formidable challenge in ensuring privacy and protection against non-consensual exploitation.
